I was just reading an article about some self-righteous and pretentious “film-maker” who dribbled about her courageous expose of homosexuality in the Catholic Church. She dramatically bemoaned the hypocrisy, intolerance, and hopelessly backward attitude of the Church. She added: “They (the Catholic Church) don't want to change anything. The church does not fit in with modern society...” I am so sick of this...If anything, the Church has continually protected homosexuals throughout History; for only in Western cultures, primarily those that stayed Catholic, as opposed to the hard-line sects in those nations that embraced the intransigent forms of Lutheranism and Puritanism of the Protestant schism, were homosexuals able to thrive. Only in Western Christian countries have homosexuals achieved unparalleled levels of social and political prestige. In much of the world, they are still an anathema. In fact, 93 nations in the world (none are in the West) still legally punish homosexuality. In 7 of these - Iran, Saudi Arabia, Yemen, United Arab Emirates, Sudan, Nigeria, Mauritania - gays and lesbians are punished with the death penalty.Why don't we hear about this? Question: Assalamu alaikum!!! what is the punishment in islamic law about homosexual?...
Fatwa: All perfect praise be to Allaah, The Lord of the Worlds. I testify that there is none worthy of worship except Allaah, and that Muhammad is His slave and Messenger. We ask Allaah to exalt his mention as well as that of his family and all his companions.
If the questioner intended to ask about Gays, the scholars, may Allaah have mercy upon them, differed in opinion in regard to the method of applying the prescribed punishment of homosexuals. However, evidences support the position of those who say that “death sentence” is the prescribed punishment of anyone who gets involved in homosexuality. This is due to the narration of Ibn ‘Abbaas, may Allaah be pleased with him, that the Prophet, sallallaahu alayhi wa sallam, said: "Whomever you find committing the act of the people of (Prophet) Loot, kill both; the doer and the person to whom it is done." [At-Tirmithi, Abu Daawood, Ibn Maajah, and Ahmad] Indeed many scholars, may Allaah have mercy upon them, quoted the consensus of the companions, may Allaah be pleased with them, on this matter. Nonetheless, scholars differed about the method of killing. Some of them said that he should be killed by sword, others said that he should be stoned to death, there are let some who said he should be burnt, and a fourth group who said that he should be held upside down on top of the highest point in the city, and then he should be thrown downward, and stone him as he is going down, exactly in the same manner by which Allaah punished the peoples of Loot. However, only a Muslim ruler may implement this punishment as we discussed in Fatwa 84227.
All previous rules apply only to Gays. As for lesbianism, there is an agreement between scholars, may Allaah have mercy upon them, that it is forbidden, and many scholars, may Allaah have mercy upon them, considered it among the major sins. Any woman who gets involved in it, she has committed a major sin and she should repent and seek Allaah’s forgiveness.
Concerning the prescribed punishment for lesbianism, the Fiqh Encyclopaedia reads: ''The jurists, may Allaah have mercy upon them, agreed that there is no prescribed punishment for lesbianism, as it is not Zina (fornication or adultery), but any woman who does it should be reprimanded as it is an act of disobedience.''
